Last Friday, Metairie Partner Andy Weinstock successfully completed a three day jury trial in Civil District Court in New Orleans, Louisiana.  Plaintiff was a 42 year old male injured when Defendant’s truck backed into the back of his vehicle.  Plaintiff’s MRIs showed a herniated disc in his neck and two in his back.  Plaintiff had undergone 2 Epidural Steroid Injections and had a third scheduled for post-trial.

Plaintiff requested $1,670,000 from the jury including $23,765.60 in stipulated medical costs and $320,000 in future medical costs.  The Jury returned a total verdict of $56,765.60.  This is less than 4% of what Plaintiff requested.

Ultimately, the jury awarded the aforementioned $23,765.60 in past medical costs, $8,000 in past physical pain and suffering and $25,000 in future medical expenses.  They declined to make any awards for past or future mental anguish, emotional distress, and loss of enjoyment of life.
